Welcome to Ocean Awareness. These Terms and Conditions govern your use of our website https://oceanawareness.ie and participation in our services.
By accessing or using the site, making a booking, or participating in any of our services, you agree to be bound by these Terms.
1. General Terms of Service
Ocean Awareness Ltd (referred to as “we”, “our”, “us”) provides ocean-based adventure activities.
By engaging in our services (via website, booking widget, email, phone, or in person), you agree to be bound by these Terms & Conditions and related policies. If you do not agree, please refrain from using our services or website.
2. Eligibility
You must be at least the age of majority in your jurisdiction, or have parental/guardian consent if underage.
You must provide accurate and complete information during booking and comply with all applicable laws.
3. Safety and Health
Participation involves risks. While we prioritise safety, ocean-based activities are inherently hazardous. All participants must comply with instructions from Ocean Awareness staff. You must declare all relevant medical conditions before booking. We reserve the right to refuse bookings on medical grounds. You consent to receive basic First Aid if needed and emergency treatment from a medical professional if required.
Health Declaration:
I hereby declare that I or my child is fit to participate in the activities run by the companies. Bookings are accepted on the basis that all details provided by the customers are accurate and true.
4. Bookings, Payments, and Cancellations
Payments are processed via our online booking partner Bloowatch. We reserve the right to change prices, services, and availability without notice. Refunds and exchanges are handled in accordance with our Right of Withdrawal and cancellation policy. In the event of unsuitable weather, we will attempt to reschedule but cannot guarantee refunds.
5. Behaviour and Conduct
We expect respectful and responsible behaviour from all participants. We reserve the right to remove any participant acting in a disruptive or dangerous manner, without refund. Participants are liable for any damage caused to property or equipment.
6. Intellectual Property
All content, logos, photographs, and materials on our website or brochures remain the intellectual property of Ocean Awareness. You may not copy or reproduce any part of our services or website without our prior written permission.
7. Photography and Media
We may take photographs during sessions for marketing purposes. If you do not wish to be photographed, please notify us in writing before your session.
8. Liability and Insurance
Participation is at your own risk. Ocean Awareness shall not be liable for loss, injury, or damage howsoever arising during your participation or while on our premises. Please do not leave valuables on vessels or premises, as we cannot accept responsibility for lost items.
9. Force Majeure
We shall not be liable for failure or delay in performance due to events beyond our reasonable control, including (but not limited to) extreme weather, pandemics, and equipment failure.
10. Complaints
Complaints should be submitted in writing to the Centre Manager at the earliest opportunity. We aim to resolve issues promptly and fairly.
11. Governing Law
These Terms are governed by Irish law. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
